Nancy Marichel Diaz de Martinez runs the risk of losing the representative if elected on Sunday, but the Constitutional Chamber of the Supreme Court decides to disqualify her from citizenship in order to promote the presidential re-election.

The Chamber yesterday acknowledged the case against Diaz de Martinez and opened a process for one of the reasons cited in Article 75 of the Constitution: “They are depriving citizens of their rights: 4th. Those who sign acts, declarations or affiliations to promote or support the re-election or continuation of the Republican presidency, or those who use direct means aimed at that decision ”.

If the aforementioned conduct is proven, the Chamber rules against Dias de Martinez and if he has already been elected he must leave that post and accept an alternative.

The Chamber bluntly states: “It should be noted that the election results of the participation of citizen Nancy Marichel Thias de Martinez as the Ghanaian party’s deputy candidate for the San Salvador Regional District will be conditional on the verdict given therein. The process of losing citizenship rights ”.

“If an assessment is made of the alleged violation of the Constitution and the loss of his political rights, Citizen Nancy Marichel Thias Martinez, if elected, will not be able to accept the post of deputy. In such a case, consider it an alternative from his parliamentary committee.”

Thias de Martinez filed 20 business days, after the announcement, in response to a claim for loss of citizenship filed against him, filed by attorney Enrique Anaya.

Anaya filed the lawsuit, noting that the candidate said in a recent interview with El Mundo that “presidential re-election needs to be resumed” and that “we need President Buchale to stay” long (…) “because we want him to be re-elected.” We know that in five years he will not have completed all his works. “

In view of this, Advocate Anaya, in her case, contends that “the Constitution provides for the loss of civil rights for attacking one of the fundamental pillars of the political, democratic and constitutional system of Salvador. The use of the presidency of the Republic is one of the cornerstones of constitutional regulation.”

Therefore, the candidate must declare the loss of citizenship rights, especially his right to active and passive suffrage.
