The decision by the Dominican Institute of Telecommunications (INDOTEL) was flatly rejected by Dominicana, SA (Viva), a public telecommunications service provider.
As this is unacceptable and lacks any legal basis, its resolution dated July 8, 2021 is given in 064-2021.
The company announced it would file legal and administrative solutions against the telecom regulatory body, including a review.
INDOTEL’s Board of Directors has issued a warrant against Vivo for paying RD .377.3 million and US $ 5.1 million for administrative offenses classified as using unauthorized frequencies and providing services without a license.
However, in a statement released this afternoon, Viva assured that the result in question was “published in violation of the principle of legal and appropriate procedure, while at the same time suffering from serious procedural issues”, which was duly pointed out to INDOTEL.
The resolution was issued despite the fact that “the permissions granted to INDOTEL by the Public Telecommunications Act not only violate the Olympics, but the apex court governs the fundamental aspects of the case and they are not yet”. Determined ”.
The VIVA report also points out that the decision by INDOTEL’s Board of Directors contradicts the company’s precedents in this regard, “creating a situation that creates clear discrimination against the company.”
